Get my Richmond quoteVirginia's Consumer Data Protection Act and breach notice rules
Richmond firms answer to two Virginia laws, and they reach very different sets of businesses. The Virginia Consumer Data Protection Act took effect January 1, 2023 1415. It covers businesses that control or process personal data of at least 100,000 Virginia consumers a year, and those with at least 25,000 that earn more than 50% of gross revenue from selling personal data 1415. There is no separate small-business exemption, but those thresholds keep most Richmond small firms outside it. A consumer-facing company with a large customer database should check its count each year.
The breach law reaches far more businesses. Virginia requires notice to the Office of the Attorney General and to affected Virginia residents without unreasonable delay after a breach 3. There is no minimum number of people for the Attorney General notice. If more than 1,000 people are notified at one time, the Attorney General and the nationwide consumer reporting agencies must also be told the timing, distribution and content of the notice 3.
Practically, that means even a small incident, such as a stolen laptop with unencrypted client records, can require a state filing. Your IT provider should be able to tell you within hours what data the device or account held and whether it was encrypted, since counsel will ask both questions first. Your attorney should confirm what applies to your firm.
Virginians filed 25,314 complaints with the FBI's IC3 in 2025, reporting $476.1 million in losses, 10th among states by losses 16.
Cybersecurity services in Richmond
A Richmond firm's first security spend should cover MFA, endpoint detection and response, email filtering and backups you have restored at least once. CISA's small business guidance stresses all four, including enforcing MFA with technical controls and regularly testing partial and full restores 17.
Budget about $8 to $25 per endpoint per month if you add managed detection and response 18. If you carry cyber insurance, expect questions on the same controls 19. Coalition's 2026 claims report, covering its policyholders' 2025 claims, found business email compromise and funds transfer fraud made up 58% of incidents, with an average claim of $116,000 20. See our small business cybersecurity guide.
IT consulting and co-managed support in Richmond
Richmond organizations with an in-house IT person often keep that role and add a provider for monitoring, security and after-hours cover. A 2026 provider estimate prices co-managed IT at $45 to $175 per user per month 21. Our co-managed IT guide explains how the work is split.
For projects and planning, external consultants commonly bill $150 to $250 per hour in one 2026 published estimate 22. See when to hire an IT consultant.
Choosing an IT support provider in Richmond
Choose a Richmond provider by testing on-site coverage, after-hours costs and breach support. Of the 401 IT services establishments in the city and Henrico combined, 287 are in Henrico and 114 in the city 411, so a downtown office may well be served from the county. Ask for the address your technician would drive from, whether on-site visits sit inside the flat fee, and who covers your site when that person is out.
Then ask what after-hours work costs and how the provider would support a Virginia breach notice, including the Attorney General filing. If you hold a government contract with security terms, ask which of those terms the provider has supported for other clients, and get the answers in the written proposal. For contract and exit questions, use our guide to choosing an MSP.
