The Nebraska rule in full No fixed deadline
Neb. Rev. Stat. §§ 87-801 to 87-808
- Notify residents
- As soon as possible and without unreasonable delay, after a prompt, good faith investigation. The business may allow for law enforcement needs and time to find the scope of the breach and restore the system.
- Notify the state
- Notify the Attorney General no later than when Nebraska residents are notified, whenever resident notice is required.
- Credit bureaus
- Not required.
- No-harm exception
- Notice is required only if the investigation finds use of the information for an unauthorized purpose has occurred or is reasonably likely to occur. The finding does not have to be written down or sent to the AG.
- Encryption
- Encrypted, redacted or otherwise unreadable data is exempt. Data is not treated as encrypted if the key was, or is reasonably believed to have been, acquired in the breach.
- Data covered beyond the basic set
- Online account credentials, biometric data, electronic ID number or routing code with access code.
- Enforcement
- The Attorney General may issue subpoenas and recover direct economic damages for each affected resident injured by a violation. The statute sets no civil penalty amount for the notice rule.

- Login credentials count on their own. A vendor must notify the owner. Section 87-808 requires reasonable security, including in vendor contracts, and makes a violation a Consumer Protection Act violation with no private lawsuit. Last amended in 2016 (notice) and 2018 (security). LB 241 (signed March 17, 2025) bars class actions over cybersecurity events unless the business acted with willful, wanton or gross negligence.

Neb. Rev. Stat. §§ 87-801 to 87-808 links timing to fact-finding. A business that learns of a possible breach investigates promptly and in good faith, and if notice is due it goes out as soon as possible and without unreasonable delay 1, with time allowed for police requests, scoping and repair.
The Attorney General's notice rides with the resident letters: no later than they go, for every breach that needs them 1. There is no headcount floor and no credit bureau step.
Login credentials and other covered data
A username or email address paired with the password or security question and answer for an online account is protected on its own 2, as are biometric data and an electronic ID number or routing code with its access code. One phished mailbox login, or a stolen password vault, can require letters with no Social Security number in sight.
Encrypted, redacted or otherwise unreadable data is outside the law 2, and Nebraska spells out the key rule in plain terms: if the key was taken, or probably was, the data no longer counts as encrypted. Keep keys and recovery codes away from the devices and backups they protect.

Get a quote for my businessThe investigation decides whether notice is needed
Letters are owed only when the investigation finds unauthorized use of the information has occurred or is reasonably likely 1. Nebraska does not require that conclusion on paper or in the Attorney General's hands, but notes on what was checked and why are the strongest support for staying quiet.
Enforcement, lawsuits and the security duty
For the notice rule, the Attorney General can issue subpoenas and recover direct economic damages for each injured Nebraska resident 3. There is no penalty figure, and no other enforcer is named.
Section 87-808 requires reasonable security, vendor contracts included, and treats a breach of that duty as a Consumer Protection Act violation that individuals cannot sue over 1. LB 241, in force since 2025, also blocks class actions against private entities over cybersecurity events unless willful, wanton or grossly negligent conduct caused them 4; individual suits and regulators are unaffected.
The Nebraska Data Privacy Act, effective January 1, 2025, has no consumer-count threshold, but small businesses as the federal Small Business Act defines them are exempt apart from its limits on selling sensitive data 5.
What a Nebraska business should do first
While the intruder is active, a Nebraska company with cyber coverage reports the claim before doing anything else, makes an FBI report online through ic3.gov, and leaves the affected devices alone until their contents are copied 679.
Then:
- Engage a forensic response firm or your own IT person to end the attack and carry out the investigation the statute requires.
- Draft the Attorney General notice at the same time as the resident letters.
- Group people by home state. Iowa and Kansas residents bring their own laws, and our breach rules for all states covers the others.
- Read the conditions carriers set against your own policy.
Our Omaha managed IT guide compares local support costs. IC3 received 3,724 complaints from Nebraskans in 2025 8.
